Terms of Service
Please, read carefully.
1. Commitment.✶ Each form/order will be reviewed and must comply with my Terms of Service.
✶ The client must provide all necessary information and requirements in advance, including visual references or any other relevant material before work begins.
✶ The client grants the artist non-exclusive rights to reference and reproduce their character design, reference material, or other intellectual property solely for the purpose of the commissioned work.
✶ The client guarantees that all provided references are legally obtained and authorized for use.
✶ The client guarantees that they have the authority to enter into this contract and are solely responsible for all decisions and approvals during the process.
✶ The artist may use commercially licensed, copyright-free, or educational materials and tools.
✶ The Client agrees not to use the Artist's work for any Non-Fungible Token (NFT) purposes or in the training/generation of Artificial Intelligence (AI) models.
✶ The artist has the right to refuse a work based on its content, subject matter, or other reasons.
✶ The artist decides the scope of their work, price, delivery, and other project details in a proposal at the artist's discretion, which may include private messages via Twitter/X, Discord, or VGen.
✶ Details must be agreed with the client before work begins.
✶ VGen Policy: For commissions accepted via VGen, the platform’s Standard Terms of Service take precedence regarding payment processing and platform-specific policies. This document applies to all creative rights, workflow, content restrictions, and specific agreements not covered by VGen’s defaults.2. Payment.✶ Payments are made at 50%/50% (Ex. A $100 illustration is made at $50 before the illustration starts and $50 at the end). Excludes VGen.
✶ The currently accepted payment methods are PayPal, via VGen, PIX, and Boleto (these are exclusive to Brazilians).
✶ Invoices, payment links, proposals, and other details will be sent to the client after the work has been approved by the client.
✶ The client must confirm that payment has been made to the artist; otherwise, the commission will be cancelled.
✶ Customers should not submit payment until the Artist requests payment.
✶ Invoices must be paid within 72 hours, or the project may be cancelled.
✶ Prices are in US dollars for foreign customers and/or those who do not have a bank account in Brazil and/or are Brazilian living abroad.
✶ Prices in Reais (R$) are exclusive to Brazilians who live in Brazil with a Brazilian bank account.
✶ Any additional fees will be charged in the customer's currency.
✶ Customer agrees that the refund policy will be followed.3. Cancellations and Refunds.✶ Partial Refunds
If the client cancels the commission within two days after the first sketch is presented, they will receive a refund of 50% of the amount paid explicitly. The Artist retains the other 50% as labor cost for the sketch.
Cancellations made after this period are not eligible for a refund, except in special circumstances (such as unforeseen issues).✶ Artist-Initiated Cancellations
If the artist is unable to complete the commission, the client will be entitled to a full refund of the amount paid up to that point.
In cases of force majeure, such as health issues or technical difficulties that prevent completion within a reasonable timeframe, the client will be notified, and both parties may agree on a new deadline or proceed with cancellation and a proportional refund.✶ Non-Refundable Conditions
No refunds will be issued once all stages have been approved and the final work has been delivered.
The client agrees not to request refunds after final delivery, provided the commission meets the agreed requirements.✶ Exceptions and Special Agreements
Exceptional situations, such as cancellations requested after more than 50% of the work is completed or personal circumstances, will be handled through direct communication between the client and the artist to reach a fair resolution.4. Deadlines and Process.✶ Production Time: Turnaround time varies significantly based on project complexity. While simpler requests may be finished in days, highly complex illustrations historically average between 3 to 6 months. The client acknowledges that a safety buffer of up to 8 months may be required for complex pieces due to the Artist's academic workload. The artist will inform the client of the estimated waiting time.
✶ The artist will provide progress updates at their discretion throughout the process.
✶ The client is responsible for reviewing and approving each stage before the next stage begins. If feedback is not provided within a reasonable timeframe, the project may be paused until feedback is received.
✶ The client may request work-in-progress updates (WIPs), provided such requests are reasonable and not excessive.
✶ Rush commissions are not accepted. Projects with strict deadlines must be discussed in advance and are subject to negotiation (additional fees may apply).
✶ Due to the artist being an engineering student, complex commissions and long-term projects cannot be assigned fixed deadlines.
✶ The client acknowledges that academic responsibilities (such as exams, assignments, or university projects) may occasionally affect the production timeline and agrees to be patient in such cases.
✶ Serial Batch Workflow: The artist works on a "One-by-One" basis. A limited number of slots (batch) will be opened. Work on a commission only begins after the previous commission in the queue is 100% completed. The artist does not multitask on multiple illustrations simultaneously.
✶ Queue Reopening: New slots will only be opened after the current batch of the waitlist is fully cleared and delivered.
✶ Final files will be delivered via Google Drive and may include formats such as .PSD, .PNG, .SVG, .JPG, among others.5. Content Restrictions.✶ Specific restrictions include: background-only commissions (no characters), realism, mecha, and imitation of other artists’ styles.
✶ Strictly Prohibited:
- Explicit Sexual Acts: Penetration, oral sex, fluids, or hardcore interactions between characters.
- Exposed Genitalia: Close-ups of genitalia or "spread" poses where genitalia is the focal point.
- Gore & Hateful Content: Extreme violence or offensive material.
✶ Allowed Content: Artistic nudity and suggestive themes are allowed. This includes pin-up styles, exposed breasts, and buttocks, focusing on aesthetics rather than explicit sexual acts.
✶ Verification: If you are unsure if your request falls under "Artistic Nudity" or "Explicit Content," please ask privately before submitting a form.6. Values.✶ Prices for works offered by the Artist are subject to change depending on project specifications, including but not limited to: commercial use (digital or merchandise), number of revisions, deadlines, illustration type, complexity, additional elements, and other custom requirements.7. Revisions, Changes, and Limits.✶ A maximum of three (3) general revisions is included during the draft stage at no additional cost.
✶ After the lineart stage, only minor revisions will be permitted, such as color adjustments or correction of small errors.
✶ Any changes requested beyond the specified revision limits will be subject to additional fees, which must be discussed and approved by the client before implementation.
✶ Any errors made by the artist will be corrected at no additional cost.
✶ Revisions and changes may impact the project timeline and queue position.
✶ The client is not permitted to edit, alter, or modify the final work unless explicitly agreed upon in advance or authorized by the artist.
✶ The client may commission only one project at a time. Multiple projects will be handled sequentially unless otherwise agreed upon. (Negotiable)8. Communication.✶ Communication will take place throughout the project, including discussion of ideas, progress updates, and necessary clarifications.
✶ Official communication channels include Twitter/X, Discord, and VGen.9. Rights of Use.✶ The Artist retains full copyright, ownership, redistribution rights, and intellectual property over the work, including but not limited to the right to display, publish, promote, and advertise the work or its progress on websites, social media, portfolios, streaming platforms, and similar channels, unless some or all rights are expressly transferred to the Client by written agreement.
✶ If the Client cancels the commission after the sketch phase has begun, the Artist retains the right to reuse the pose, composition, concept, and ideas developed during the process for any purpose.
✶ Personal-use commissions do not include commercial rights and may be used for profile pictures, personal social media posts, gifts, and other non-profit purposes only.
✶ Digital Commercial Usage requires an additional fee ranging from 30% to 50% of the base commission price and applies to any digital commercial application, including but not limited to promotional materials, advertisements, videos, album covers, comics, novels, game assets, CG illustrations, concept art, and loading screens.
✶ Commercial Merchandise Usage: Using the artwork for physical merchandise (keychains, shirts, mugs, etc.) requires a specific license.:
- Fee Structure: This fee is negotiable and not fixed. It will be calculated based on the scale of production, variety of items, and estimated sales volume.]
- Base Rate: Negotiations typically start at 80% of the base price for small batches but may increase for large-scale commercial operations or mass production.
- The Client must declare their intent to produce merchandise during the proposal stage so a fair price can be agreed upon.
✶ Upon request, the Artist may assign copyright ownership to the Client through a separate written agreement, subject to additional fees and conditions.10. Confidentiality.✶ The artist and the client agree that any non-public information exchanged between the parties, including but not limited to personal data, technical details, marketing strategies, payment information, or confidential commercial information, shall be treated as confidential and shall not be disclosed to third parties without prior written consent from the rightful owner of such information.
✶ The client may request that the project remains private for an additional period of up to six (6) months after completion.
✶ Requests for permanent confidentiality may be subject to an additional fee.
✶ The client’s social media accounts will not be publicly disclosed by the artist without prior authorization from the client.11. Acceptance.✶ The client confirms that they are at least 18 years of age and legally capable of entering into this agreement, or that a legal guardian has agreed to these terms on their behalf.
✶ The effective date of this agreement shall be the date of the first confirmed payment transaction.
✶ By confirming a commission with the artist, the client acknowledges and agrees to be bound by these Terms of Service.Note: Agencies, companies, and other organizations must contact the Artist directly to negotiate specific contractual terms.
